VITYEL — LEGAL

Terms & Conditions

Last updated: 7/28/2026 · Contact: [email protected] · Operated by OgouLabs, Haiti

In short

  • Vityel lets you create digital business cards, bio pages, QR menus, booking pages and payment pages.
  • You own your content; you are responsible for what you publish and for the leads you collect.
  • Paid plans are billed through our checkout (SureCart) and renew automatically until cancelled.
  • Payments made to you through your Pay Me page go directly to your own accounts — Vityel never holds your money.
  • These terms are a template — review them with a legal professional before publishing.

1. Who we are & acceptance

These Terms & Conditions (“Terms”) govern your use of Vityel (“the Service”), operated by [COMPANY NAME] (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

Vityel provides tools to create and share digital business cards, One Pager (bio-link) pages, digital menus with WhatsApp ordering, appointment booking pages, dynamic QR codes and “Pay Me” payment pages, together with QR generation, lead capture and analytics, in English, French and Spanish.

Some pages can be installed on a phone like an app (PWA) and may be cached for offline viewing.

3. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your country, to create an account.

4. Plans, billing & renewals

Free and paid plans differ by limits (number of cards, pages, monthly scans) and features (Digital Menu, Booking, Dynamic QR, Pay Me, CSV export, white-label). Current limits are shown on the Pricing page.

Paid subscriptions are processed by our checkout provider (SureCart) and renew automatically at the end of each billing period until cancelled. Price changes will be announced in advance and apply from the next renewal.

If a subscription ends or lapses, your account returns to the Free plan limits; content above those limits may become unpublished but is not deleted.

5. Refunds

[Describe your refund policy here — e.g. “Payments are non-refundable except where required by law” or “14-day money-back guarantee on first purchase”. Keep it consistent with what your checkout shows.]

6. Your content

You keep full ownership of the content you add (names, logos, photos, menus, prices, links). You grant us a limited licence to host and display that content solely to operate the Service.

You confirm you have the right to use everything you upload, and that your content does not infringe anyone’s rights.

7. Acceptable use

You may not use the Service for anything unlawful, fraudulent, deceptive or harmful; to send spam; to impersonate others; to sell prohibited goods or services; or to attempt to break, overload or reverse-engineer the platform. We may suspend or remove content or accounts that violate these rules.

8. Leads & your customers

When visitors submit their contact details, place an order, request a booking or report a payment on your pages, that information (“Leads”) is delivered to you. Towards those people, you are the data controller: you must handle their information lawfully, honour the marketing consent they gave (recorded as Yes/No), and answer their requests.

Orders and bookings are confirmed between you and your customer (typically on WhatsApp). Vityel is not a party to those transactions.

9. Pay Me payments

The Pay Me page displays the payment methods you configure (e.g. MonCash, NatCash, PayPal, Cash App, Zelle, bank transfer). Funds move directly from your customer to your own accounts through those providers. We do not receive, hold or transfer money, and we are not responsible for disputes between you and your customers or your payment providers.

10. White-label & agencies

Agency plans may display the agency’s own brand on client-facing pages. The agency remains responsible for its clients’ content and for its own commitments towards its clients.

11. Availability & changes

We work to keep the Service available and fast, but we do not guarantee uninterrupted operation. We may improve, modify or discontinue features; material changes will be communicated when reasonably possible.

12. Disclaimer & limitation of liability

The Service is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profits, or loss of data, and our total liability for any claim is limited to the amounts you paid us in the twelve (12) months before the claim.

13. Termination

You can stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that breach these Terms. You can export your leads and data (CSV) before closing your account.

14. Governing law

These Terms are governed by the laws of [Haiti / your jurisdiction]. Disputes will be handled by the competent courts of [City, Country], unless mandatory law provides otherwise.
